Acceptable Use & Abuse Policy (reference translation)

This policy is part of the MOKLAV GLOBAL GK Terms of Service.

1. Prohibited

1. Spam (unsolicited bulk or advertising email) and open relays.
2. Phishing, malware distribution, and botnet command-and-control.
3. Content infringing copyright, trademarks, reputation, privacy or other rights.
4. Child sexual abuse material and other content illegal under Japanese law.
5. DNS amplification, DoS, port scanning, unauthorized access and other attacks.
6. Leaving resources abusable by others, e.g. open DNS resolvers.
7. Anything else that violates the law or the Terms.

2. Enforcement

1. After review, we may warn you, ask you to fix the problem, suspend the affected service, or terminate.
2. Where possible we contact you first. In urgent cases we may suspend without notice to limit harm.
3. When investigating, we look at information only within the limits of the secrecy of communications (Telecommunications Business Act, Art.4), or with your consent, or as otherwise permitted by law.
4. We may preserve relevant records as permitted by law.

3. Reporting abuse

• the domain or IP address;
• the time, with time zone;
• evidence such as email headers, URLs or logs;
• your contact details.

4. Takedown requests

1. A person who claims their rights are infringed should tell us:
• the location of the content (e.g. URL);
• the right infringed;
• the reasons;
• their name and contact details.

The Telecom Services Association guideline forms may be used.

1. Under the Information Distribution Platform Act, we may take takedown measures in either of these cases:
• there are reasonable grounds to believe the content infringes rights; or
• we asked the sender whether they consent to removal, and they did not object within the statutory period (generally 7 days).
2. We notify the sender where appropriate.

5. Requests to disclose sender information

1. We handle requests under that Act.
2. Unless we cannot reach the sender, we ask for their opinion first.
3. We disclose only on a court disclosure order or another legal basis, or with the sender's consent.

6. Requests from authorities

We provide information covered by the secrecy of communications only with a warrant or another legal basis. We assess voluntary requests case by case under the secrecy of communications and APPI.
